Hardship Distributions Rule Reflects a Decade of Legislative Changes

The IRS final rule on 401(k) hardship withdrawals expands the safe harbor conditions to determine the existence of an immediate and heavy financial need and whether a hardship distribution is necessary to satisfy such need. Plan sponsors should consider reviewing their plans’ hardship distribution provisions and amending them to reflect the new regulations.
