Kentucky Court Rejects Mandatory Employment Arbitration Agreement

The Federal Arbitration Act doesn’t pre-empt a state law that prohibits employers from requiring workers to waive, arbitrate or reduce their statutory rights as a condition of employment, according to the Kentucky Supreme Court. If the decision is appealed, however, it is not expected to withstand U.S. Supreme Court scrutiny.
