First Amendment Claim Based on Report of Texting and Driving Advances

A public employee’s complaints about a co-worker’s texting while driving could form the basis of a First Amendment retaliation claim, which could proceed to the evidence-gathering stage of litigation, the U.S. District Court for the Southern District of Mississippi ruled.
